TERMS AND RISK ACCEPTANCE

 

Registration and Cancellation

The registration must be in writing and is binding unless a written cancellation is received within 10 days after registration or no later than 10 days before the course start date (whichever occurs first). If cancellation occurs after this period, the full course fee remains payable, regardless of whether the fee has been paid or not.

Payment

The course fee is due for payment in accordance with the due date on the invoice. Any payment arrangements must be agreed upon in writing. Course registration and certificate issuance will not take place until full payment has been received. In cases where an individual registers personally but the payment is to be made by a company or organization, the participant remains personally liable if payment is not received within a reasonable time. If an individual registers one or more participants, the registrant is ultimately financially responsible.

Course Cancellation and Changes to Date/Location

We reserve the right to reschedule the course date and/or change the course location if there are too few participants or if unforeseen circumstances beyond our control (force majeure) arise. Examples of force majeure include weather and ice conditions.

Consent for the Use of Personal Data

By registering, I consent to NMKS storing my personal data and using it for course administration, certificate issuance, and potential registration with the Norwegian Maritime Authority (Sjøfartsdirektoratet). My information may also be used to offer relevant courses in the future.

NMKS will request a personal identification number (11 digits social security number or D-number), which will be stored and forwarded to the Norwegian Maritime Authority in accordance with registration and certification requirements.

Governing Law and Dispute Resolution

Any disputes will be governed by Norwegian law. In the event of a dispute, the parties shall first attempt to resolve the issue through negotiations. If negotiations are unsuccessful, the matter shall be settled in court, unless the parties agree to arbitration. The dispute does not exempt the parties from their obligations. The venue for legal proceedings is Oslo District Court, and any cases before the Conciliation Board (Forliksrådet) shall be brought before the Conciliation Board in Oslo.

Risk Associated with Course Participation – General

NMKS has a well-structured safety system and implements necessary measures to minimize risk during course activities. Participants will receive training on handling various situations that may arise.

By participating in NMKS activities, I confirm that I will follow the instructor's guidance and that I am aware of the risks and potential injuries that may occur.

I also acknowledge that NMKS has liability insurance only and does not provide accident insurance for participants. This means that I am not insured through NMKS in the event of an accident for which I am responsible or in cases where NMKS cannot be held liable.

Participants under the influence of alcohol or other intoxicating substances will be immediately removed from the course by the instructor without any right to a refund.

Risk Associated with High-Speed Certification (HHB)

Operating high-speed vessels involves inherent risks. These vessels may experience strong impacts and sudden course changes, which can place significant strain on the body. Participants must therefore not have medical conditions that could be worsened by such impacts.
